POSTPONEMENT OF THE SECURE PAYMENT SYSTEM FOR REAL ESTATE SALES
Pursuant to the Regulation Amending the Regulation on Real Estate Trade, published in the Official Gazette No. 33238 dated 29 April 2026, where all or part of the payment in a real estate sale is made in cash, by bank transfer or by electronic funds transfer, it had become mandatory, as of 1 July 2026, for the sale price to be paid through the Secure Payment System (the “System”), which enables the simultaneous transfer of the ownership of the real estate and the sale price.
However, Provisional Article 1 of the Regulation on Real Estate Trade (the “Regulation”) authorised the Ministry of Trade (the “Ministry”) to postpone the implementation date of the System by up to three months.
Pursuant to this authority, the Ministry announced on 26 June 2026 that the implementation date of the System had been postponed until 1 October 2026.
In this context, we would like to remind you that, as of 1 October 2026, pursuant to Supplementary Article 1 of the Regulation:
- Where all or part of the payment in real estate sales conducted by businesses and other natural or legal persons is made in cash, by bank transfer, by electronic funds transfer or through any other payment method determined by the Ministry of Trade, the real estate sale price must be paid through a payment system designed to ensure the simultaneous transfer of the ownership of the real estate and the sale price.
- Where all or part of the real estate sale price is financed by a bank, as defined under Banking Law No. 5411 dated 19 October 2005, or by a financing company or savings finance company, as defined under the Law on Financial Leasing, Factoring, Financing and Savings Finance Companies No. 6361 dated 21 November 2012, the payment system must be used for payments other than the loan amount.
- A usage fee will be charged for each transaction carried out through the payment system, and such fee will be deducted from the real estate sale price transferred to the seller.
