Amendments Regarding the Law Numbered 7181 ‘’Amendment of the Land Title Registry Law’’

The law numbered 7181 regarding the Amendment of the Land Title Registry Law and some other laws has been published and entered into force on 10 July 2019.

Accordingly, the new regulation has abolished Article 22:

The requirement to attach photos to official deeds for transactions to be carried out by real persons before the land registry, and

Besides, the following clause is adopted as Additional Article 3:

Notification shall be made to the owners of the shares, beneficiaries of real and personal rights that are affected adversely due to a fault caused by cadaster determination or transactions, revealing the reasons of the fault and the share structure following the rectification. Rectification shall be made within 30 days provided that the consent is given by the relevant persons. In the absence of such consent, the inaccurate registry shall be ex officio rectified by the land registry and the relevant persons shall be notified about the consequence of the transaction along with their right to file a a lawsuit within 60 days against the rectification before the civil court of first instance .

The following clause is adopted as Article 26, subclause 2:.

In the contracts for the transfer of ownership for immovable property, in case the parties are in different title deeds registry offices or at the Turkish missions abroad (Consulates), the parties’ wills can be taken separately

and the contract may thusly be concluded. The procedures and principles regarding the implementation of this paragraph shall be determined by regulation.
