MANDATORY MONITORING OF THE NATIONAL ELECTRONIC NOTIFICATION SYSTEM (UETS) FOR COMPANIES IN TÜRKİYE

Under Turkish law, official notifications issued by public authorities are served electronically through the National Electronic Notification System (“Ulusal Elektronik Tebligat Sistemi”/ “UETS”). This system constitutes the legally valid method for delivering a wide range of formal communications to companies.

These electronic notifications may originate from judicial bodies, such as courts and enforcement offices, as well as from administrative authorities and public institutions. Examples include, but are not limited to:

  • Notifications of lawsuits and court judgments
  • Enforcement and bankruptcy proceedings
  • Tax assessments and tax penalties
  • Administrative fines
  • Licensing or regulatory procedures
  • Other official communications from governmental authorities.

Pursuant to the applicable legislation, all companies incorporated in Türkiye are required to obtain and maintain an active UETS address. Once a notification is delivered to the company’s UETS mailbox, it is deemed legally served within five (5) days following its delivery, regardless of whether it has actually been read by the recipient (“deemed notification” principle).

If a company fails to activate its UETS address despite the legal obligation, notifications may be served through physical means (e.g., via PTT). However, such non-compliance may also trigger administrative sanctions and other legal consequences under applicable legislation.

In light of this legal framework, companies are strongly advised to designate a responsible person within the organization to regularly monitor the company’s UETS mailbox. Failure to review incoming electronic notifications in a timely manner may lead to missed deadlines for legal remedies, responses, or payments, which could result in adverse legal or financial consequences.

Accordingly, implementing an internal monitoring procedure and assigning a responsible individual for the regular review of the company’s UETS account is essential to ensure compliance and to safeguard the company’s legal rights.
