On-line submission of Work Permit Applications via e-state account, using e-signature device

As per the legislation in force and per the established practice of the Ministry of

Family, Labor and Social Security (in Turkish “Aile, Çalışma ve Sosyal Hizmetler Bakanlığı”, hereinafter referred to as the “Ministry”), the foreigner to be employed in Turkey shall apply to work permit before the Turkish foreign mission located at the homeland or at the country of residence of such employee and obtain a reference number which shall then be used by the employer for the work permit application to the Ministry via e-state account (in Turkish “e-devlet”; i.e. the official online account granted solely to each Turkish citizen). That being the case, for the foreigners residing in Turkey for at least six months with a residence permit preserving its validity, the employers may proceed to such application directly via the e-state account; without need to prior application to the Turkish foreign missions.

Kindly note that the employer wishing to employ a foreigner employee shall meet the required conditions to do so. Such conditions are announced by the Ministry via its official website.

As from the March 2018; the work permit applications require the respect to a set of cumulative conditions. Briefly; in order to proceed to the work permit applications on  behalf  of  the  foreigner  employees;  the  e-statement  (in  Turkish  “ebildirge”) holder of the employer shall proceed to the workplace registry via his/her e-state account; then he/she may personally submit the work permit application via his/her own e-state account using his/her own e-signature device (a USB device provided upon payment of a certain fee by several providers of such service) or may appoint online an e-statement user who shall proceed in this respect via such user’s own e-state account with this user’s own e-signature device.

Since such requirements are cumulative; the person to be entitled shall obviously be a Turkish citizen.

In case of non-respect of either one of the aforementioned conditions, the missing point to be faced shall be rectified via the appointment of the appropriate person as the e-statement holder before the competent Directorate of Social Security Institution, via the issuance of an e-signature for the e-statement holder etc., depending on the requirements of each the specific case.

Upon approval of the application, the Ministry informs the applicant via e-mail for the payment of the application fees upon payment of which the work permit shall be issued.

Please note that the aforementioned is currently the sole application method for the issuance or the extension of work permits and no other application such as manually presentated work permit application folders etc. is available.
