NEW REGULATION FOR COSMETIC PRODUCTS HARMONIZED WITH EU LEGISLATION

A new Cosmetic Regulation (in Turkish, “Kozmetik Ürünler Yönetmeliği”, hereinafter referred to as the “New Regulation”) which has been prepared within the framework of harmonization with the European Union legislation by taking into account the Regulation Numbered 1223/2009 of the European Parliament and of the Council dated 30 November 2009 on cosmetic products, has been published by Turkish Medicines and Medical Devices Agency of the Ministry of Health (in Turkish, “Türkiye İlaç ve Tıbbi Cihaz Kurumu” or “TITCK”) in the Duplicate Official Gazette dated 8 May 2023 and numbered 32184.

Within the frame of this New Regulation, the actors of the cosmetic sector, i.e.importer, manufacturer, distributor and responsible person were introduced to the legislation.

The aim of this New Regulation is “to establish rules to be complied with by any cosmetic product made available on the market, in order to ensure the functioning of the internal market and a high level of protection of human health” as stated in Article 1.

Pursuant to Articles 38 and 39 of the New Regulation, this New Regulation shall enter into force six (6) months following its publication, and abrogate the Cosmetics Regulation numbered 25823 and dated 23 May 2005 (hereinafter referred to as the “Abrogated Regulation”).

Please kindly note that the cosmetic products already released to the market in line with the Abrogated Regulation, could remain in the market for two (2) years as of the entry into force of the New Regulation.
